ProTech: Refunds, Returns & Exchange Terms of Pro-tec Service For Customers

Welcome to the Pro-tech Athletics (hereon known as Pro-tech) sports e-commerce website (the "Site", "website") under BrandsPass and thank you for your interest and support of our products and services (henceforth known individually and/ or collectively, "Pro-tech", "we", "us" or "our")

The Terms & Conditions here describe the rights and obligations of the Buyer for the return of products and services paid and delivered or undelivered, and the refund of any monies paid in full or in part, if applicable, for such returns.

1   Return, Exchange & Refund of Pro-tech Goods & Services

1.1   Subject to the terms and conditions described here and the Terms of Service and Sales, a Buyer may apply for return, exchange and/ or refund of the purchased items (“Items”) under the following circumstances

  1.   Good or services were not received by the buyer after ordering the products or services.
  2.   The good or service was defective, damaged or incomplete upon delivery
  3.   Goods or services which are not of the brand, type or specification (wrong colour, size etc) you ordered
  4.   Goods or services which do not perform the function they are reasonably expected to perform.
  5. Goods or services whose expiry date has been exceeded at the time of delivery or the expiry date is unreasonably close to the delivery date such that the product may not be used completely before the expiry date.

1.2   A Buyer may only cancel an order before payment is made.

1.3   Pro-tech reserves the right to cancel any transaction on the Site and Buyer agrees that Buyer’s sole remedy will be to receive a refund of the Buyer’s purchase monies.

1.4   If you have redeemed any Pro-tech Loyalty Dollars and Pro-tech Vouchers for your transaction and you are successful in obtaining a refund based on Pro-tech’s Refunds and Return Policy, Pro-tech shall refund the monies you have actually paid for the item and credit back any redeemed Pro-tech Loyalty Dollars to your Account separately.

1.5   Pro-tech does not monitor the cancellation, return and refund process for offline payments.

1.6   Refunds to Buyers shall be made to their BrandsPass wallet or bank account, whichever is convenient to BrandsPass or the Vendor, within fourteen (14) working days of the return or refund request being approved.

1.7   To enjoy a faster and more convenient experience when returning the Item, the Buyer should ensure that the Item, including any complimentary items such as accessories that come with the Item, must be returned to the Vendor in the condition received by Buyer on delivery. We will recommend Buyer to take a photo of the Item upon receipt.

1.8   Pro-tech reserves the right to decide on acceding to the buyer's request for refunds, cancellations, returns and exchanges.


2   Vendor- Buyer Disputes and Dispute Resolution

2.1   In the event a problem arises in a transaction, the Buyer and Pro-tech agree to communicate with each other first to attempt to resolve such dispute by mutual discussions and agreement. BrandsPass shall use reasonable efforts to facilitate a mutually agreeable solution for all parties. Any judgement it issues to resolve the matter is final and mutually binding on the Vendor and Buyer.

2.2   If the matter cannot be resolved by mutual discussions, Users may approach the claims tribunal of their local jurisdiction to resolve any dispute arising from a transaction.

2.3   Each Buyer and Pro-tech agrees that it will not bring suit or otherwise assert any claim against Pro-tech or its Affiliates (except where Pro-tech or its Affiliates is the Vendor of the product that the claim relates to) in relation to any transaction made on the Site or any dispute related to such transaction.
